Are they copy righted to the newspaper?
I don't want to be in trouble but want to take photos for my ebay store.

I use the photos on my tweeter and facebook weekly.
So I think they are no copy rights.

Face book and Tweeting are different from a commercial use. Legally, I would think you would need to get permission from the person who owns the photograph, and Hillary does not own them.

This is directed to the readers of the blog that have a question about using photos from the blog for their own purposes. Now I do not have a definitive answer for you from the legal perspective but I would like to take this opportunity to let you know my thoughts as a frequent contributor of photographic material. First off you should recognize that even the most simplest photos can take an extraordinary amount of time to conceptualize, arrange, shoot, and edit to produce what I believe will be both an educational and visual pleasure to the readers of this blog. I then take the additional time to properly identify each piece and the designer and color. In the many years I have been a contributor I know of only two minor mistakes I have made in this process and I have tried to rectify those when they occurred because as a collector I know the value of getting accurate information. I use both my own library of Blenko literature and available internet sites to verify the model, designer and colors of the pieces that are seen here on the Blog. As for using the photos that have appeared I have been amazed over the years whenever I do a Google search of Blenko “Images” where you can find my photos being used for various webpages or Ebay listings. I know that imitation is the highest form of flattery but there are times that I have been tempted to contact those using my material to take issue with it’s use. I personally have come to use this standard, which has yet to be broken by any such intrusion, which is that as long as the person using my image is not trying to sell that specific image I am flattered that they believed it to be one that was visually pleasing. I know that several readers have often commented on saving images to use in their searches and for that I am also pleased that I can be of help identifying and finding additional pleasure in the collecting experience. It was photos by the Blenko Four and the Blenko Museum that inspired and educated me when I was starting out. With that said, I send my photos to the blog expecting the images to be copyright protected and solely for the use of the blog or individual readers without extending republication rights.

I hope this is helpful to the readers and those who respect the creative process.

WHEN THE NEWSPAPER PUBOLISHES THE PHOTO IT THEN BECOMES THE OWNER.
SO HILARY CAN NOT HELP YOU.

Well said Bruce.
I know D C has a policy of asking those folk taking photos (from Vintage Glass Museum of Blenko or Blenko archives )have the photo removed immediately.
Your photos are much better so its only right that you do this also.
I copy your photos for a notebook as do many of the people in our group of 12-16. We use them much as we use the catalogs.
Thank you for your photos they add much to this blog.

I commented that we didn't need permission for Facebook and Tweeter. I was wrong. RE: Facebook and Tweeter my husband who is also a lawyer
said you would need the permission of Hillary as she and the Herald own the blog.
So unless you have permission from the original owner you would need permission from Herald or Dr Hillary.

but it is incorrect.
I doubt Hillary or the paper would mind if the photo is labeled correctly as to its origin.
